15-year-old Sandro Sardariani was sentenced to two months of pre-trial detention for stealing a bottle of beer. The boy is now in Gldani prison. Sandro is a minor with disabilities.
Ombudsman Giorgi Tugushi has addressed to the head of the Ministry of Corrections and Probation Khatuna Kalmakhelidze asking to transfer Sandro Sardariani to a proper institution. At the moment, the boy is in the 18th medical institution for adults.
The representative of the Ombudsman, Natia Imnadze: "The Ombudsman has demanded to transfer Sandro to the proper institution: either to the minors, or, as required by his health state, to another medical facility".
Sandro was arrested on May 17. Two days after his detention, trial took place, and the teenager was transferred to the hospital of the 8th prison, and then, a few days later - to the center of expertise located in the village of Dighomi.
Grisha Sardariani, Sandro's father: "We were told that he was in the center of expertise for observation. Yesterday he got food and other necessities - we were told that he was transferred to a hospital of Gldani prison. I want to know how my son is. He can neither read nor write, responds inadequately, and he cannot stay without his parents. Maybe someone will say how he is".
A government lawyer, David Bochorishvili, protects 15-year-old Sandro Sardariani, but according to Sandro's father, his son was sentenced to 2-month pre-trial detention in lawyer's absence.
Grisha Sardariani: "I cannot contact the lawyer; he does not respond phone calls. My child needs medical aid. Our family is indigent, socially disadvantaged; no one works in our family. My boy is very scared, he only could say, "Dad, I've cried .. "
David Bochorishvili, Sardariani's lawyer: "The teenager is ill; we asked to transfer him under his parents' supervision, but the court has not satisfied our requirements. Teenager does not even understand what he had done. Based on this the investigation was to appoint an expertise to determine whether he was sane. If his insanity is proved, the court cannot prosecute him. We'll get answer within 20 days; the boy while remains in the same institution for adults".
Human rights activists call Sandro Sardariani's case a gross violation of human rights.
