Magnitsky may be convicted posthumously
Interior Ministry intends to convict condemn a lawyer of Hermitage Capital fund Sergei Magnitsky posthumously, according to his former colleagues. However, the court may be avoided if Magnitsky's relatives refuse to defend honor and dignity of the deceased. In addition, the trial in absentia is waiting for the head of Hermitage Capital Management William Browder.
"Investigator of MIA Boris Kibisom has sent a letter to the relatives of Sergei Magnitsky and lawyers of the Hermitage Capital stating that the preliminary investigation on the case is completed and after the lawyers got familiarized with the materials it will be sent to court for a posthumous condemnation of Magnitsky and conviction in absentia of the head of the Hermitage Capital Management William Browder", the agency's interlocutor said.
Meanwhile, the criminal case against Magnitsky may be terminated. "I'm re-explaining that if the family isn't interested in further acquitting consideration of the case, including the desire to exonerate the deceased, criminal proceedings may be terminated by the investigator", said in investigator's letter to Sergei Magnitsky's relatives.
According to the fund representative, the relatives of the deceased believe that "the only way to avoid post-mortem condemnation of Magnitsky is refusal of his relatives from the right to defend his honor and dignity", ITAR-TASS reported.
